Types of Title Deeds in kenya and transfer process

In Kenya, there are several types of title deeds that can be used to transfer ownership of property. The most common ones include:

• Freehold title deeds – These are issued for properties that are not subject to any lease or tenure, and the owner has absolute ownership and control of the property.
• Leasehold title deeds – These are issued for properties that are subject to a lease agreement with a landowner, usually for a period of 99 or 999 years.

So then what do you need to get your title deed?

With increasing interest in owning land and property in Kenya, there is a need to understand the new property registration process as outlined below. The new property registration process in Kenya through the ministry of Lands and Physical Planning in 2019 announced the new guidelines governing the property registration process.

The process of transferring ownership of property in Kenya involves the following steps:

• Obtain a search from the Ministry of Lands to verify the ownership of the property and to check if there are any encumbrances on the property.
• Draft a sale agreement that outlines the terms of the sale, including the purchase price and payment terms.
• Sign the sale agreement in the presence of witnesses.
• Pay stamp duty and any other applicable taxes at the Kenya Revenue Authority (KRA).
• Lodge the transfer documents, including the sale agreement, title deed, and land rent clearance certificate, at the Ministry of Lands.
• Obtain a consent to transfer from the relevant authorities, such as the county government and the National Land Commission.
• Wait for the transfer to be processed by the Ministry of Lands, which usually takes a few weeks.
• Collect the new title deed from the Ministry of Lands once the transfer has been completed.

Freehold

• It is the greatest interest a person can have on land as it gives the holder absolute ownership of the land for life.

• The title deed generally has no restrictions as to the use or occupation.
• A freehold interest is also known as absolute proprietorship. It is common in Agriculture lands. It’s advisable to change it to freehold when converting land use to commercial or residential purposes. In the past, this was not enforced by with the county government in place, as is the case now

I am George CEO Optiven Real Estate, I once lost Ksh.5 million shillings on a land transaction and it was one year of pain and stress. During that period, these are the lessons that I learnt that I would like to share with most of us who want to keep investing in real estate in a safe manner.

1. Check who the directors of the business are and whether they are real and or alive – Look into their past records and carry out due diligence on them. You can know directors by asking for a copy of CR12. You can also Google the Directors to get more info on them.
2. Ask the firm if they have a successful project and let them give proof of the same – Visit that project to ascertain the facts.
3. Ask the competitors if they are aware of the real estate firm offering you a deal – Remember that hearing adverts from mainstream media does not mean that the company is authentic. Testimonials are not 100% proof of authenticity, nor is the use of models or media personalities in the same.
4. Check if they have a registered office, with staff and visit the office – This is not 100% proof but it helps.
5. Insist on visiting the project site before committing your funds – If in the Diaspora, send your representative or a lawyer.
6. Always obey your gut feeling – Once again, obey your GUT feeling.
7. Ask for the company profile  – Go thought it and check the company structure.
