However, land remains a volatile investment but one which has great returns in the long run. ”According to Khasoa, “be intentional as an investor in real estate to notice sellers rushing to close the transaction while offering prices that are significantly below market value. Be on the lookout too for sellers withholding original documents, and when on ground confirm presence of beacons on the land because missing beacons, unclear boundaries and neighbours objections to the sale are all red flags calling for caution.”

So, before buying land in Kenya, carry out thorough due diligence to avoid fraud, disputes, and unexpected costs and follow the following steps.
- Verify Ownership by requesting a copy of the title deed from the seller – Also confirm that the seller’s name matches the name on the title. If the seller is acting on behalf of a company, verify their authority to sell.
- Conduct an Official Land Search – Visit the relevant land registry or use the Ministry of Lands’ online platform to conduct an official search. Some of the important aspects you need to confirm include the registered owner, land size, encumbrances such as loans, caveats, or court orders attached to the land.
- Confirm the Land Exists and Visit the Site – As a keen investor we recommend that you physically inspect the property. Take time to verify the boundaries and acreage on the ground. Also ensure the land matches the details on the title.
- Engage a Licensed Surveyor – The role of the Surveyor is to confirm the beacon positions and boundaries. Verify that there are no boundary disputes with neighbors.
- Check Land Use and Zoning – Confirm with the county government whether the land is zoned for residential, commercial, agricultural, or industrial use. Ensure your intended use of the land you want to purchase is permitted.
- Verify Access Roads – Confirm there is legal access to the property. Ensure roads shown on maps exist on the ground.
- Check for Outstanding Rates and Rent – This are due and paid to the relevant county government where the land is located. Obtain the following key certificates:-
- Land Rates Clearance Certificate (from the county government)
- Land Rent Clearance Certificate (for leasehold properties)
- Investigate Potential Disputes – Speak with neighbors and local administration. Check whether there are ongoing court cases, succession disputes, or family claims affecting the land.
- Confirm Environmental Factors – Check for flooding, riparian restrictions, wetlands, power lines, or other environmental issues. Consider soil quality if purchasing agricultural land. Obtain Land Control Board Consent (for Agricultural Land). Agricultural land transactions generally require approval from the relevant Land Control Board.
- Use a Qualified Advocate – Engage an advocate experienced in property transactions. They will draft and review agreements, conduct legal due diligence, oversee the transfer process. Also engage for a sale agreement which should clearly state purchase price, deposit amount, completion period, and obligations of both parties
